The person that is ranked dead last in a game probably isn't even a cheater. I know they don't even need proof for their times in reality. I'm ranked like 500th or so in MKDS, and I don't have proof for my times because it's tough to get a real good vid of an MKDS run, and the fact that I'm ranked 500th. I'm not shameless enough to upload times that are that shit.

^That also goes back to what I said earlier about it not being fair to tell someone they will be let back on under certain circumstances, then not going through with it after that person has done everything asked of him. As far as I know (and I could be wrong, as I've only been around 5 years myself), this situation has not ever happened before, hence why a rule was created to address it now. That's why the rule is "in the future, cheaters will not get a chance to prove themselves". The policy was not in effect at the time that Fenner was allowed back on, so the rule would not apply to him as long as he does not cheat again. If he does, he's permabanned and would not be given another chance. We're dealing with this because a policy was not in place beforehand on this site, and the rule was put in place to prevent having to deal with this in the future.

I think the fact that Fenner is good (and site champion, as a matter of fact) did play a role, but it's not "special treatment" or whatever. I don't think it would matter who it was on whatever MK site, if the site #1 was being questioned, proof would be asked for to maintain the credibility of the site, regardless of the person's past. We have asked for every form of proof that Fenner is physically able to give, and up to now, since Fenner's return, he hasn't cheated on this site. He may have with the Cyberscore thing, but he has not here. We're keeping an eye out on Fenner, and he will be required to continue to prove himself over and over to stay here. Also, for what it's worth, Fenner has more proof than anyone on any MK site, hands down. As long as he maintains that, then I don't see a problem with him staying.

I don't see the reason in banning cheaters, you just have to force them to live vid every PR they make, denying skilled people to be on the site is retarded

and if you think a live vid isn't 100% proof you're retarded; unless you can prove otherwise?

Forcing him to make a live vid for every PR he makes is not as straightforward as it might seem. It basically means that every PR he makes has to be live witnessed by a validated moderator, while interaction is taking place. I foresee that in the long run this will be an extremely tedious and demanding process; the time that is asked of the moderators can become disproportional in the event that Fenner will play a lot and for years to come.

It only takes a precooked recording (which is almost as simple as faking a plain replay, the only problem would be to get it on the DS) coupled to synchronized button presses to immitate live playing. I immediately admit it's far fetched*, but as stated, absolutely not outside the realms of possiblity. The only way this can be kept in check is through livestreams, in which the validator interacts with the person under scrutiny and asks him at certain intervals to randomly hit such and such tree 5 times, etc. (to exclude potential precookedness).

*And I definitely don't think this is going on in the Fenner case, in fact I'd be extremely surprised if so. Plus we would never find out if so anyway.

Fenner has, live, infront of shock driven times which are number 2 on the site - only after his own WR's. He's driven single laps showing he can set wr's.

Karel, you're asking me to invoke a new rule and apply it to the past? Can you imagine what would happen if that took place in politics/law?

I'm using common sense, this has not happened before, we've managed the situation as best as we can. Now its happened we're putting measures into place that it doesn't happen again.
