Uhhh ok, that's cool and all, but modding is still modding, and modding is the equivalent to hacking.

Whether or not it's for enjoyment or an advantage, it's still hacking.
Mods are just a subcategory for hacks, you are modifying files, in order to get a change. It can be for enjoyment, it can be to get infinite items for something.
Like I said, what Alaktorn said is not incorrect, it quite literally was a hacked time. It came from and on a modified channel on the Wii, which can only be acquirable by hacking the Wii.
What you seem to be getting confused with is when people say hacking is the equivalent of cheating. While in some forms this is true, and others it is not, but you assumed Alaktorn said 'hacking' into the sense that he meant 'cheating'.
Is it cheating? Well, if you wanted to get technical, yes it would be. If you want to know why, it's because the channel he got the previous time on was acquired by illegal means. Yes, hacking and modding the Wii is illegal, even the websites that tell you that this is 100% legal, are flat out lying to you. Jail breaking laws only apply to phones and computers, if people actually read it, it even flat out says that consoles among other electronics are not protected under that law.
Well the feds come after you? Highly unlikely, because the cancellation of the EULA is enough for most companies, and then can essentially fuck you over if they wanted I.E bricking your Wii or any other console if they so chose to. Even banning suffices, which is the route Microsoft takes along with Nintendo and Sony.
Now is it cheating among the pp? That's the debate that's currently being had.
This is, the way I see it, will eventually being run like a PC gaming server, where certain rules regarding texture hacks/skins will have to be governed. Some could be illegal, other may be legal, or it may be entirely legal, or entirely illegal.
If I had to guess, if Nintendo could actually detect Riivolution, or HBC without the use of a console update, I.E through their own servers when times are submitted(some cheats can't be detected, rapid fire, slow-mo, other ones I can't think of atm), those times would be deleted, and you would be banned from their charts as well.
